The employment and pensions aspects of any outsourcing arrangement can be complex: both legally and practically.

From an employment perspective, it is important that a proper balance is struck between commercial achievability and absolute compliance (where relevant) with the Transfer of Undertakings (Protection of Employment) Regulations 2006. The pensions aspect of any corporate transaction are complex, and outsourcing arrangements are no exception. Employee transfers involving current (or former) public sector employees represent a particular challenge.

We have considerable experience in advising customer and supplier side clients on first generation and second generation arrangements, both on-shore and off-shore, in both the private and public sector.
