Road Regulation

A key element of any development proposal is its impact on the local road network.

Over the years the traditional traffic impact analysis has matured into more sophisticated transportation assessments moving the focus from 'predict and provide' to the requirement for sustainable transport and the capturing of transport gain from developers. Ann Faulds was the legal adviser to the authors of the original TIA Guidelines produced by the Institution of Highways and Transportation.

Ann Faulds and Trudi Craggs are co-authors of the leading textbook on Scottish Roads Law.

With our extensive experience on major transport infrastructure projects, we can advise on the legal implications of many roads issues including audit of Transport Assessments, STAG, road construction consents, traffic regulation orders, stopping up orders and the key access legal concept of 'the public right of passage' – "what is a road and can anyone hold my development to ransom on this basis?".
