The EU Mediation Directive, which promotes the use of mediation in civil and commercial cross-border disputes, must be implemented by Member States by May 2011. Although any Directive encouraging mediation is a positive step, the impact of this Directive will be limited because it only applies to cross-border disputes. It is up to individual Member States to decide whether they also want to apply the provisions of the Directive to internal cases.
